Section G - Criminal Records Disclosure:

All positions within The Priory Federation of Academies Trust will require the employee to have an appropriate level of disclosure check by the Disclosure and Barring Service (DBS).

This will be required regardless of whether or not the employee holds a current Disclosure Certificate.

Disclosure checks will only be requested once an offer of employment has been made. The results of this check will not necessarily be a bar to obtaining the position you have applied for and will not be used unfairly.

The DBS check is made under the provisions of the Police Act (1997). The Trust will confirm your identity at the interview and submit the application to the Disclosure and Barring Service once an offer of employment has been made, paying the necessary fee. The 1997 Police Act allows employers to obtain information on people who are being considered for appointment to positions involving work with children, vulnerable adults or other positions of trust.
The position you are applying for is ‘exempt’ from the Rehabilitation of Offenders Act 1974, so you are required to declare:
• All unspent conditional cautions or convictions under the Rehabilitation of Offenders Act 1974.
• All spent adult cautions (simple or conditional) or spent convictions that are not ‘protected’ as defined by the Rehabilitation of Offenders Act 1974 (Exceptions) Order 1975 (as amended).
The amendments to the Exceptions Order provide that certain ‘spent’ convictions and cautions are ‘protected’ and are not subject to disclosure to employers and cannot be taken into account.
If you are unsure whether you need to disclose criminal information you should seek legal advice or you may wish to contact Nacro or Unlock for impartial advice:
• Visit the Nacro website at - or contact their help line on 0300 123 1999.
• Visit the Unlock website at- or contact their help line on 01634 247350.

Full guidance and criteria on the protection and filtering of these cautions and convictions can also be found here: Telling an employer, university or college about your criminal record - GOV.UK (

You must also inform us if you are on the Children’s Barred List, disqualified from working with children, or subject to sanctions or restrictions imposed by a regulatory body. It is an offence to apply for the role if you are barred from engaging in regulated activity relevant to children.

A person’s criminal record will not, in itself, debar that person from being appointed to this post. Any information given will be reviewed by the Human Resources Director and treated in the strictest confidence. Suitable applicants will not be refused posts because of offences, which are not relevant to, and do not place them at or make them a risk in, the role for which they are applying.

Failure to disclose any criminal offences or providing false information, which is an offence, could result in this application being rejected, or dismissal if the applicant has been selected, and possible referral to the police.

Please note that if have answered yes to the above and are successfully shortlisted for interview, you will be asked to complete a further Criminal Record Disclosure Form. The information will be used only to inform the overall assessment for your suitability for the role, where it is relevant.
